OCTOBER 9, 2008
A public meeting of the York Area Regional Police Commission was held on Thursday, October 9, 2008 at the York Area Regional Building, 33 Oak St., York, PA 17402.
Those present were Paul Smith, Commissioner, Robert Kessler, Commissioner, Philip Briddell, Commissioner, Paul Knepper, Commissioner, Jana Smith, Commissioner, John Sanford, Commissioner, Thomas Gross, Police Chief and Tracy Fleming, Business Administrator.
Commissioner Paul Smith called the meeting to order at 7:00 p.m.

PUBLIC COMMENTS
Mayor Scott inquired if minutes were still being sent to Mrs. Thompson.
APPROVAL OR AMENDMENT TO MINUTES OF SEPTEMBER 11, 2008
Commissioner Paul Smith asked for a motion to approve the minutes of the
September 11, 2008 meeting. Commissioner Briddell made the motion to approve the
minutes. Commissioner Kessler seconded the motion. Motion carried.
CORRESPONDENCE AND COMMUNICATIONS
Chief Gross provided copies of two letters of appreciation. One from the
District Attorney commending Detectives Meyers, Barley, Burke and Sergeant
Stabley for their dedicated investigation into a homicide case. This was a two
year investigation of the Bernice Ness case. The other letter was from Children
and Youth Services for assistance provided by Sergeant Thoman and Officer
Longnecker.
CIVIL SERVICE COMMISSION REPORT
Chief Gross had nothing new to report at this time.
FINANCIAL REPORT
Chief Gross advised that the grant money has been coming in for the various
grants. We also received payment on a grant from the Bureau of Justice
Assistance of $6,691.00. This grant is for video equipment. The grant was
awarded in July 2007 and is approximately $12,000.00. The grant money is paid to
York City. We submit our paperwork to York City for our portion of the grant
payment.
State Aid money was received for funding of the uniform and non-uniform pension plans. This event occurred after the September report. The amount was over $300,000.00. This is the Act 205 money. The money is paid to Windsor Township and York Township. The townships then pay the money to us.
Health and hospitalization expense needs to be analyzed.
Police Services – Other is for billing York County School of Technology for the School Resource Officer. They are in the second year. They need to be invoiced.
The Chief discussed the legal fees being high. This is due to a lawsuit filed by a person who had been in custody. It is to go to trial in November, 2008.
Two vehicles have been purchased and are not on the September Report. We should be a little under budget in this category.
This is the second year in a row we have not paid anything on the radios. They are to be here this month and will be installed in the cars. We have $62,000.00 budgeted for the County radios and will not pay until we receive them.
Approval of Expenses for September 1 to September 30, 2008 - $401,628.16
Commissioner Smith asked for a motion to approve the expenses for September 1 –
30, 2008 in the amount of $401,628.16. The motion was made by Commissioner
Briddell, seconded by Commissioner Kessler. Motion carried.
SOLICITOR’S REPORT
There was nothing to report.
POLICE CHIEF’S REPORT
Chief Gross reported that the transition is going well with the new Business
Administrator. We are now up to date on the time reports. The Balance Sheet and
other statements are in good shape. We are discussing some projects we want to
work on in the future.
The Chief reported that a committee has been set up to organize a Citizen’s Police Academy. We are planning to start in early 2009. It will be a six week program, two hours a night. It will be a get to know your police department type of program. It will include how we investigate, what the detectives do and a tour of the facility. They would also meet people from the various assignments – Sergeants, K-9, bicycle, motorcycle, forensics and SWAT. Hopefully this will encourage more volunteerism between us and the community.
The Chief noted that he received messages of appreciation for the work the officers do at the York County School of Technology.
Chief Gross stated that we received two citizens complaints, one is under investigation and one was considered unfounded.
The Chief reminded the Commissioners that the department meeting is tomorrow and to be here around 10:30. There will be presentation of awards. There will also be presentations from United Way, the Employee Assistance Program, and Pension Funds.
The Chief noted to everyone that the next commission meeting is on the first Thursday not the second Thursday in November. The date is November 6, 2008.
COMMISSIONER’S COMMENTS
Commissioner Briddell asked the Chief the status of the report on the residence
of the individual’s arrested. Cheryl has worked on; the Chief needs to do a
final review.
Commissioner Jana Smith welcomed Tracy Fleming to the Department.
Commissioner Knepper thanked the Chief for his help in providing him a copy of the Police Department’s Award Program.
Commissioner Sanford asked the Chief the status on the research of the alarm fines. The Chief is still working on. He also reminded everyone the Red Cross is having an awards breakfast on October 30, 2008. The officers won in their category. He needs to know who will be attending so he can get tickets.
Commissioner Paul Smith and Commissioner Jana Smith were at a fire department meeting. They would like our officers to show more appreciation towards the fire police to help with their morale.
Mayor Scott inquired why the $500.00 check was not cashed from the carnival. The Chief informed her it went to the police association not the department.

A public meeting of the York Area Regional Police Commission was held on Thursday, September 11, 2008 at the York Area Regional Building, 33 Oak Street, York, PA 17402.
Those present were Paul Smith, Commissioner, Robert Kessler, Commissioner, Philip Briddell, Commissioner, Paul Knepper, Commissioner, John Sanford, Commissioner, Thomas Gross, Police Chief and Cheryl Fetrow Administrative Clerk.
Commissioner Paul Smith called the meeting to order at 7:00 p.m.
The Pledge of Allegiance was followed by a moment of silence in memory of those who lost their lives on September 11, 2001. Chief Gross advised the Commission that 72 police officers who served with the New York City Police, Port Authority and other law enforcement agencies were killed on that date.

APPROVAL OR AMENDMENT OF MINUTES OF AUGUST 14, 2008
Commissioner Paul Smith asked for a motion to approve the minutes of the August
14, 2008 meeting. Commissioner Kessler made the motion to approve the minutes.
Commissioner Briddell seconded the motion. Motion carried.
CORRESPONDENCE AND COMMUNICATIONS
There were no comments or communications.
CIVIL SERVICE COMMISSION REPORT
Chief Gross had nothing to report at this time.
FINANCIAL REPORT:
Chief Gross advised he received notice from EMC, the liability carrier is giving
the department a ten percent discount on the professional liability insurance
due to our accreditation. The exact amount is unknown right now but it is
expected to be approximately $3,000.
a) Chief Gross also passed out revised Balance Sheet, Revenue and Expense Detail Report, and Budget vs. Actual worksheet to commission members.
b) Commissioner Smith asked for approval of the expenses in the amount of $480,958.35. Commissioner Briddell made the motion, seconded by Commissioner Kessler. Motion carried.
c) DRAFT BUDGET REVIEW
Chief Gross presented the preliminary draft budget. Chief Gross expects
revisions to be made due to
Additional income from grant income. The Chief also discussed how the changes in
the health care will
affect the budget figures. The figures will be reviewed with the new business
administrator. There
were questions regarding budgeted expenses including the radios and a new power
generator for the
office complex. Chief Gross is estimating an increase of 4.37% in the unit cost
which would be
passed on to the municipalities. Commissioner Paul Smith inquired about the K-9
expense. This was
budgeted for 2008 but will be included in 2009. Commission Knepper advised he is
willing to let the
K-9 units use his storage facilities for training purposes.
d) MINIMUM MUNICIPAL OBLIGATION REPORT APPROVAL (MMO)
The department is required to submit to the state each year, the minimum
obligation to the pension.
The motion to approve the MMO for the uniformed pension plan in the amount of
$281,109.56 was
Made by Commissioner Kessler and seconded by Commissioner Briddell, motion
carried. A motion to
adopt the MMO for the non-uniformed pension plan in the amount of $58,862.13 was
made by Commissioner Briddell, seconded by Commissioner Kessler. Motion carried.
Commissioner Sanford requested Chief Gross to address the possibility of
increasing fees for
officers to respond to false alarms in the various municipalities.
SOLICITOR’S REPORT
There was nothing to report.
POLICE CHIEF’S REPORT
Chief Gross commented on the request from last month’s meeting from Commissioner
Briddell regarding statistics on defendants committing crimes in the area
covered by York Area Regional Police.
Tracy Fleming started her position with the department on Tuesday, Sept. 9th at the suggested salary.
Trick or Treat night for Dallastown and Red Lion Boroughs had to be changed to Thursday, Oct. 30, 2008 due to a conflict with the Red Lion and Dallastown High School football game to be held at Red Lion. The remainder of the municipalities will still be Friday, October 31, 2008.
Chief Gross passed out invitations and R.S.V.P. forms to the commissions for
a dinner to be held Saturday,
October 11, 2008 at the Springvale U.M. Church social hall. The Civil Service
Board and the Pension Board
Members and spouses will also be invited to attend. Tracy Fleming will be there
to meet the Boards.
Scott Gebhardt, a York College student, started an internship with the department this week. He will be reporting to Sgt. Varner.
There were two letters of appreciation received. One was for Raymond Krzywulak for help in an accident investigation and one for Peter Montgomery for recovery of a stolen vehicle. There were two citizen complaints being investigated.
Chief Gross updated the Commission on the October 10, 2008 departmental meeting. Chief Gross requested the Commissioners try to attend at 10:30 a.m. for the departmental photograph.
Beverly Scott advised the Dallastown Recreation Board had forwarded a check in the amount of $500 to the Police Association for their participation in the Dallastown Carnival held recently. Mayor Scott also asked the Commission for their opinions on permitting skateboarding on borough streets.
Commission Knepper commented on the accreditation stickers placed on the patrol vehicles. Chief Gross advised stickers were also ordered to be placed on the department’s motorcycle.
Mayor Sanford advised the officers who were involved in the house explosion on East Prospect Road in January have been nominated for the Hero’s Award.
The Commission recessed for an executive session at 7:40 p.m. to discuss a personnel issue and a criminal investigation.

PUBLIC COMMENTS
Commissioner Paul Smith welcomed Troop 43 Dallastown member, Ben Staub, who is
attending the meeting as part of the requirements for his Communications Badge
for the Boys Scouts of America.
APPROVAL OR AMENDMENT TO MINUTES OF JULY 10, 2008 AND AUGUST 4, 2008
Commissioner Paul Smith asked for a motion to approve the minutes of July 10th
and August 4, 2008 meetings. Commissioner Briddell made the motion to approve
those minutes. Commission Kessler seconded the motion, motion carried.
CORRESPONDENCE AND COMMUNICATIONS
Chief Gross presented communication from the Mayor of Dallastown, Beverly Scott
who presented a donation to the K-9 Unit of the York Area Regional Police in the
amount of $100. The donation was made by two couples who were married by Mayor
Scott. Mayor Scott does not accept money for performing ceremonies.
Chief Gross also presented correspondence from the Pennsylvania Law Enforcement Accredition Commission giving official notice of York Area Regional Police being an accreditted agency. The Commission congratulated Chief Gross and his staff for a job well done. Chief Gross advised accredition logos will be displayed on all marked vehicles.
COLLECTIVE BARGAINING AGREEMENT
Chief Gross advised that sometime after the collective bargaining agreement vote
was taken on May 8th through a computer transfer of wording, an entire section
was missing from Article V on Grievances. There were only two steps of the
grievance process when, in fact, it should be three steps. The attorney drafted
a new agreement with the correct clause and forwarded it to the Chief. It has
been forwarded to the Association. Commissioner Briddell made the motion to
approve the corrected Collective Bargain-ing Agreement, seconded by Commissioner
Kessler, motion carried.
IROP RESOLUTION
Chief Gross indicated there were two minor wording matters that conflicted with
the collective bargaining agreement. The Chief asked for approval for resolution
2008-5 which corrects these changes.
Chief Gross advised an unfair labor practice charge was filed with the Pennsylvania Labor Relations Board on July 21, 2008 and was sent to York Township and Windsor Township. A hearing has been set for Tuesday, October 14, 2008. This action should also correct this matter. Commission Kessler motioned to adopt Resolution 2008-5, seconded by Commissioner Briddell, motioned carried.
CIVIL SERVICE COMMISSION REPORT
Chief Gross had nothing to report at this time.
FINANCIAL REPORT
Chief Gross advised he had an application for reimbursement for training for
Officers Dobek and Mitchell. MPOETC reimburses 60% of the officers salary while
attending training at the academy, as well as for travel and meal expenditures.
The submission for reimbursement for Officer Dobek is $10,884.76 and for Officer
Mitchell $13,280.89. Commission Briddell motioned to apply for reimbursement,
seconded by Commissioner Kessler, motion carried.
Chief Gross reviewed the Revenue and Expense Budget vs. Actual and Commerce Bank account balances for the Commission review. The Chief advised he hopes to have preliminary budget information for the September meeting. Chief Gross also advised the CD which came due has been placed temporarily in the department checking/savings account due to the low rate Commerce Bank was currently offering. The $200,000 will be placed in another CD when a better rate is found.
Mayor Scott requested individual grant and donation amounts be highlighted on financial reports.
Commission Smith asked for approval of the expenses in the amount of $575.948.54. Commissioner Kessler made the motion, seconded by Commissioner Briddell, motion carried.
Chief Gross advised the Commissioners were provided with copies of the annual audit by Kochenour Earnest, Smyser and Burg. Everything was found to be in compliance with the exceptions of stamping the check signings and segregation of duties due to limited size of the office staff. Commission Briddell commented regarding depreciation schedules for department property.
SOLICITOR=S REPORT
There was nothing to report.
BUSINESS ADMINISTRATOR POSITION
Chief Gross advised three candidates have been reviewed and extensive background
investigations completed including a criminal history, driving record and
financial history. After careful review and contacts with references, Chief
Gross recommended hiring Tracy Flemming for the position. She brings with her
skills including a C.P.A. and experience with our accounting and payroll
software. The Commission will go into executive session to review the two other
candidates and to make their final decision at that time.
POLICE CHIEF=S REPORT
There were no homicides or fatal accidents or disciplinary actions this month.
There were two suicides and one citizen complaint which was not substantiated.
Sick leave and training reports were also presented this month. Chief Gross
advised he has received positive comments regarding October 31st as the chosen
date for the observance of Trick or Treat in the eight municipalities.
Chief Gross has received final approval for Corporal Ken Schollenberger to be assigned to the Quick Response Team Negotiation Unit. He will be attending training in the future for this assignment.
Also, there are tentative plans for a departmental meeting on Friday, October 10, 2008. Chief Gross requested the Commissioners plan to attend for the group photograph. Departmental issues, the United Way Campaign and employee assistance updates will be presented also.
Commission Briddell commented on the York Metro presentation. Discussion followed on arrests made by York Area Regional and the number of defendants who are out of our service area as opposed to being residents of our area. Mayor Sanford requested to be notified when the presentation will be made to Windsor Township. Mayor Scott would like to know the upcoming dates for the York Counts presentations.
The Commission recessed for an executive session at 7:50 p.m. to discuss the Business Administrator applicants and a personnel issue.
The meeting was reconvened at 8:15 p.m. Commissioner Briddell motioned to offer the position of Business Administrator to Tracey Flemming with a salary of $55,000. Second was made by Commissioner Kessler, motion carried.
The motion to adjourn was made by Commissioner Kessler at 8:17 p.m., seconded by Commissioner Briddell. Motion carried.

A recessed public meeting from July 10, 2008, of the York Area Regional Police Commission was held on Monday, August 4, 2008 at the York Area Regional Police Building, 33 Oak Street, York PA 17402.
Those present: Paul Smith, Commissioner, Philip Briddell, Commissioner, Robert Kessler, Commissioner, Jan Smith, Commissioner, John Sanford, Commissioner, Thomas Gross, Police Chief, and Wanda Stibitz.
Commissioner Paul Smith called the meeting to order at 4:00 p.m.
Chief Gross asked the Commission to consider a motion for Amendment 3 to the York Area Regional Police Non-Uniformed Pension Plan. He stated that it was the intent to have the plan calculate pensions similar to the Uniformed Pension Plan, which was based on the last 36 months of wages prior to retirement. It was found that the plan document stated that it is calculated on the last three calendar years, which does not include any compensation for the current year for retirees. Amendment 3 would change the calculation to include the 36 months wages and compensation prior to the date of retirement. Paul Smith asked for questions from the Commission and asked for a motion on Amendment 3. A motion was made by Commissioner Briddell to approve Amendment 3 to the York Area Regional Police Non-Uniformed Pension Plan, seconded by Commissioner Kessler, motion carried.
The Commission interviewed seven applicants for the Business Administrator position and the second step of a grievance.
Commissioner Briddell made a motion to respond to the grievance, that the
Commission was in agreement with Chief Gross= response, seconded by Commissioner
Kessler, motion carried.
The meeting adjourned at 8:35 p.m.

APPROVAL OR AMENDMENT TO MINUTES OF JUNE 12, 2008
Commissioner Paul Smith asked for a motion to approve the minutes of the June
12, 2008 meeting. Commissioner Kessler made the motion to approve those minutes.
Commissioner Briddell seconded the motion, motion carried.
AWARD PRESENTATIONS
Chief Gross presented awards as follows:
Corporal Dyke, who was not present, received a Chief=s Commendation for his
actions, putting himself at risk after a vehicle accident on January 26, 2008 in
Windsor Township, where a vehicle was discovered submerged in a creek and with
the help of a local farmer, entered the creek to determine the condition of the
occupant and render aid. The lone individual in the vehicle was, however,
deceased.
Chief Gross presented Edward Myers with a Citizen=s Commendation in recognition of his assistance, providing his time on January 26, 2008 after arriving at the scene of a vehicle accident where a vehicle was submerged in a creek. Mr. Myers provided his personal tractor to pull the vehicle from the creek. He was thanked by the Commission on the behalf of York Area Regional Police Department.
A Chief=s Commendation was presented to Officer Montgomery and Detective Weyth Barley, for the investigation of numerous thefts that were made by a suspect impersonating a cable tv employee.
Chief Gross advised a Chief=s Commendation will be presented to Officer Sanders (who was not present) for thefts which occurred on March 18, 2008 in Windsor Township, where Officer Sanders located a suspicious vehicle with three occupants and found evidence in the vehicle that were stolen from vehicles in York Area Regional Police jurisdiction and Springettsbury Township.
Chief Gross presented a Chief=s Commendation to Officer Zech for his quick actions in locating a suspect in a vehicle after a shooting on June 3, 2008 and the description was dispatched by York County Control. The suspect was taken into custody after shooting and killing his girlfriend and a search warrant was obtained and a handgun was recovered.
Chief Gross presented Chief=s Commendations to Officer Buschman, Officer Damon, Officer Mallette and Sergeant Fishel (who was not present) for a vehicle accident on January 5, 2008 where the vehicle struck a house on East Prospect Rd. in Windsor Township where a gas leak caused an explosion in the house. Officer Buschman and Sergeant Fishel moved an injured firefighter from danger and saved him from further injury.
Commissioner Briddell thanked all those commended for their professionalism.
CORRESPONDENCE AND COMMUNICATIONS
Chief Gross advised correspondence was received from Seven Valleys Borough requesting consideration for police protection by York Area Regional Police. After a discussion on the three mile distance from the closest point of current jurisdiction, costs and service options, it was the wishes of the Commission for Chief Gross to respond to them with costs, rates and the annual report of the department.
IROP RESOLUTION
Chief Gross advised changes with amendments were being resolved by Attorneys
Rudolf and Caputo and will be finalized at a later date. At this time, four
officers have submitted applications to the IROP and have been accepted by
Attorney Rudolf and were reviewed with changes per the bargaining agreement.
Chief Gross advised there is a clause on the grievance procedure that was omitted from the collective bargaining agreement. The amendment will be ready for the August agenda.
CIVIL SERVICE COMMISSION REPORT
Chief Gross had nothing new to report at this time.
FINANCIAL REPORT
Chief Gross advised the approval for the second year of the school resource
officer grant was received for July 2008 through June 2009 in the amount of
$31,475.00. This required a motion for acceptance. The motion was made by
Commissioner Briddell, seconded by Commissioner Kessler, motion carried.
Chief Gross noted that this grant places Officer Morris at the York County School of Technology. The second year of the grant, it states that fifty percent of the grant, we have agreed with York County School of Technology to invoice them for one and one half police units to cover the other fifty percent.
Monthly Report
Chief Gross highlighted the revenue and expenses report. Grants received are
over budget, there will be application made for a D.C.E.D grant and also
expected to receive $27,000 in reimbursements for the academy training for the
two new officers.
Chief Gross advised the health care is a little over budget and he had no answer for that right now but would look into it. Gasoline costs are holding steady for now, maintenance and repair on building is up slightly due to upgrades to the alarm system required for accreditation. Ammunition costs are up due to availability and advance purchasing.
Commissioner Briddell introduced an idea for another investment of a certificate of deposit and Chief Gross reminded the Commission that there is one CD that is currently invested. Commissioner Smith advised that Commerce Bank had notified the department prior to interest rates dropping and on their recommendation, invested in the cd. He is confident with their recommendations. Chief Gross advised that future expenses will reduce the cash balance in the near future. Chief Gross advised the radio equipment that was budgeted for could be invested for a short time.
There was a brief discussion on the gasoline purchase agreement with Sheetz and the possibility of looking at purchases from Rutters.
Approval of Expenses for June 1 - 30, 2008 - $486,428.03
Commissioner Smith asked for a motion to approve the expenses for June, 2008 in
the amount of $486,428.03 That motion was made by Commissioner Briddell,
seconded by Commissioner Kessler, motion carried.
SOLICITOR=S REPORT
There was nothing to report.
POLICE CHIEF=S REPORT
Chief Gross provided a copy of the official retirement letter from Wanda Stibitz
with her last day of work being August 7, 2008.
Chief Gross provided a letter of the accreditation, the assessment report and
the request for the attendance of the meeting on July 16, 2008 at the Lancaster
Host Resort. Chief Gross, Commissioner Smith, Sergeant Varner, and Corporal
Schollenberger will be in attendance for the presentation of the Accreditation.
The report was complimentary to all the officers of the department and named the
officers that were dealt with. The Commission thanked Chief Gross and the
department for their efforts and success.
Chief Gross additionally reported of the homicide in York Township, a suicide in Windsor Borough and a letter of appreciation was received from York County School of Technology for Officer Morris.
Chief Gross reported an advertisement was placed for a business administrator and also posted on the PA Chiefs of Police website and the departments website. Approximately 35 applications were received to date and will be accepted until July 21, 2008. There was a discussion on the interview process and the Commission=s involvement in that process. It was decided that Chief Gross would review the applications and the Commission would interview approximately five final applicants during a recessed meeting scheduled for August 4, 2008 at 4 p.m.
Chief Gross asked the Commission to set a date for Halloween Trick or Treat date for the municipalities to coordinate schedules. The Commission agreed that Friday, October 31 would be appropriate and Chief Gross will notify the municipalities of that date to consider.
Chief Gross advised the liability insurance was renewed with Kocman Insurance. There were attempts to get other quotes but none could compete with the current carrier. The current policy came in less than the previous year and included an increase of police liability from one million to two million limit and grouped that under the umbrella policy. The worker=s compensation decreased with experience. Chief Gross advised the department will continue to compare rates. Chief Gross also will report to Kocman Insurance when the department receives the official accreditation.
Chief Gross asked the Commission to consider ordering a second motorcycle with the vehicle budget having a remaining balance of approximately $60,000. In order to have the motorcycle by October, it would need to be ordered now. Total costs with lights, etc. would be approximately $18,600.
COMMISSIONER=S COMMENTS
Commissioner Kessler, Commissioner Jan Smith, Commissioner Knepper and
Commissioner Sanford all congratulated Chief Gross and the department on a job
well done with the accreditation. Commissioner Briddell asked that the
municipalities receive a letter referencing the department accreditation.
Chief Gross advised the accreditation report will be available to all the officers. He thanked the Commission but said had it not been for the efforts of the officers, it wouldn=t have happened.
Commissioner Smith asked the Commission to consider changes to any newly hired non-uniformed employees to contribute to their health insurance. After a discussion, a motion was made by Commissioner Briddell to require the newly hired non-uniformed employees to contribute ten percent to their health care benefits, seconded by Commissioner Kessler, motion carried.
The Commission recessed for an executive session at 8:10 p.m. to discuss a personnel issue and insurance plan issue.
The Commission reconvened at 8:50 p.m. A motion was made by Commissioner Briddell, seconded by Commissioner Knepper to give Tara Hengst an increase to $14.50 per hour and to include for consideration for increases at the same time the non-uniformed employees receive raises, motion carried.
A motion was made by Commissioner Kessler, seconded by Commissioner Briddell that Chief Gross would be eligible to take advantage of the 30% health insurance waiver in addition to the current contract benefits, motion carried.
A motion was made by Commissioner Kessler at 8:55 p.m. to recess the meeting
until August 4, 2008 at 4:00 p.m., seconded by Commissioner Briddell, motion
carried.
